These Terms and Conditions govern the rental of roll-off dumpsters and the use of services provided by DumpStar LLC, doing business as DumpStar (“Company”, “we”, “us”, or “our”). By requesting service, scheduling a dumpster, contacting us, or using our website, the customer (“Customer”) agrees to the terms outlined below.
1. Dumpster Rental Agreement
DumpStar rents roll-off dumpster containers to customers for temporary use. All dumpsters remain the property of DumpStar LLC at all times.
The Customer assumes full responsibility for the dumpster from the time of delivery until it is picked up by DumpStar.
2. Placement of Dumpster
The Customer is responsible for selecting a safe and accessible location for dumpster placement.
DumpStar is not responsible for damage to:
driveways
asphalt
concrete
pavers
sidewalks
landscaping
underground utilities
irrigation systems
that may occur during delivery, placement, or removal of the dumpster.
The weight of the truck, the dumpster, and the debris may cause damage to surfaces. The Customer assumes all risk associated with the placement location and ground conditions.
3. Access to Container
The Customer must ensure clear and safe access for delivery and pickup.
If the dumpster cannot be delivered or retrieved due to blocked access, including but not limited to:
parked vehicles
locked gates
construction equipment
snow or ice
debris or other obstructions
a trip fee or return service charge may apply.
4. Rental Period
The rental period begins on the day the dumpster is delivered.
If the dumpster remains on site beyond the agreed rental period, daily extension fees may apply.
DumpStar reserves the right to retrieve the dumpster if necessary.
5. Weight Limits
Each dumpster includes a maximum allowable weight limit.
If the weight exceeds the included limit, the Customer will be responsible for overweight disposal charges based on landfill rates.
DumpStar reserves the right to refuse pickup of dumpsters that exceed safe hauling limits.
6. Level Loading Requirement
Debris must not extend above the top edge of the dumpster.
Overfilled dumpsters are unsafe to transport and may not be picked up until excess material is removed.
Additional service charges may apply if a second trip is required.
7. Prohibited Materials
The following materials are prohibited from being placed in dumpsters:
hazardous waste
chemicals
paint or solvents
oil or fuels
asbestos-containing materials
batteries
tires
propane tanks
flammable liquids
medical waste
explosives
radioactive materials
liquid waste
The Customer is responsible for all cleanup costs, disposal fees, environmental penalties, or damages resulting from prohibited materials placed in the dumpster.
8. Rainwater and Weather Conditions
DumpStar is not responsible for additional dumpster weight caused by rainwater, snow, or other weather conditions.
The Customer remains responsible for overweight charges resulting from weather conditions.
9. Permits and Local Regulations
The Customer is responsible for obtaining any required permits if the dumpster is placed on:
public streets
sidewalks
public right-of-way
The Customer must comply with all applicable city, county, and HOA regulations.
DumpStar is not responsible for fines or penalties resulting from permit violations.
10. Relocation of Dumpster
Once a dumpster has been delivered, relocation may require additional service fees.
Customers should confirm placement location prior to delivery.
11. Damage to Dumpster
The Customer is responsible for damage to the dumpster caused by:
fire
misuse
prohibited materials
equipment loading
intentional damage
Repair or replacement costs may be charged if damage occurs during the rental period.
12. Indemnification
The Customer agrees to defend, indemnify, and hold harmless DumpStar LLC from any claims, damages, injuries, losses, or liabilities arising from the use of the dumpster, including improper loading or unsafe conditions.
13. Payment Terms
Payment terms are established at the time of booking.
Additional charges may apply for:
overweight disposal fees
extended rental periods
blocked pickup trip fees
prohibited material removal
Failure to pay outstanding balances may result in collection actions.
14. SMS Messaging Terms
DumpStar may communicate with customers via SMS text messaging regarding services.
SMS Consent Communication
Phone numbers collected through website forms or service requests may be used for service-related communication.
SMS consent and phone numbers will not be shared with third parties or affiliates for marketing purposes.
Consent to receive SMS messages is not required to purchase services.
Types of SMS Communications
Customers who opt in may receive text messages related to:
dumpster delivery notifications
pickup scheduling
appointment reminders
service updates
billing inquiries
Example message:
“Hello, this is DumpStar confirming your dumpster delivery scheduled for tomorrow. Reply STOP to opt out of SMS messaging at any time.”
Message Frequency
Message frequency may vary depending on service activity. Customers may receive 1 to 4 SMS messages per week.
Messaging Fees
Standard message and data rates may apply depending on your wireless carrier.
DumpStar is not responsible for charges imposed by mobile providers.
Opt-In Method
Customers may opt in to SMS messaging by:
submitting website contact forms
requesting service
providing consent through booking forms
Opt-Out Method
Customers may opt out at any time by replying:
STOP
to any SMS message from DumpStar.

15. Limitation of Liability
DumpStar LLC is not liable for indirect, incidental, or consequential damages related to dumpster rental services except where required by law.
16. Governing Law
These Terms and Conditions are governed by the laws of the State of Colorado.
17. Updates to Terms
DumpStar LLC reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on this website.
